U.S. Department of Labor Recovers $87,850 in Back Wages for 40 Warner Truck Center Employees

WEST VALLEY CITY, Utah -- The U.S. Department of Labor announced today that Warner Truck Center, West Valley City, Utah, has paid $87,241 in back minimum wages to 38 employees for violations of the Fair Labor Standards Act (FLSA) minimum wage requirements. The company also paid $609 in overtime back wages to one employee.

“This investigation reflects the department’s commitment to protecting the minimum wage rights of workers and ensuring that workers receive the full wages they have earned,” said Dean A. Campbell, district director for the department’s Wage and Hour Division in Salt Lake City.

The employer violated the FLSA by failing to pay salespersons the required minimum wage during weeks in which no sales were made. The employer also violated the overtime provisions of the Act by failing to pay an hourly employee time and one-half after 40 hours of work in a workweek. The company agreed to future compliance and payment of all back wages found due.

The FLSA, enforced by the Wage and Hour Division, requires that covered workers be paid at least the federal minimum wage for all hours worked. It also requires that workers be paid time and one-half their regular rate of pay for hours worked over 40 in a single workweek, and that employers maintain accurate records of employees’ wages, hours and other conditions of employment.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year 2004 for more than 288,000 workers. Average days to resolve a complaint decreased during that time from 108 days to 92 days.
