Abstract: The
Benefits Review Board reviews and decides appeals which raise substantial
questions of law or fact from decisions of administrative law judges regarding
claims for benefits under the Black Lung Benefits Act and the Longshore and
Harbor Workers’ Compensation Act (LHWCA). The Board maintains a
comprehensive collection of its final dispositions in its offices in
Washington,D.C. Decisions issued since November 1996 are also available in
electronic format on the Internet and from a private publisher. The target
audiences for these decisions are the Black Lung and the LHWCA community
(appellants, their representatives, Federal employees administering the Act),
law libraries, and members of the general public interested in workers’
compensation law.
Purpose: Board decisions are public
documents and must be accessible to the public. Prior decisions establish case
law and create precedents in determining current and future appeals.
Agency Program: The BRB is an independent entity within the
Department of Labor responsible for reviewing and deciding appeals of
administrative law judge (ALJ) decisions under the Black Lung Benefits Act and
the Longshore Harbor Workers’ Compensation Act. Any party adversely
affected by an ALJ decision under these Acts may file an appeal requesting that
the Board review the decision.
