The Newstead Town Board has adopted a detailed zoning code including RA, R1, R2, R3, C2, I2 and MHP zones in an attempt to protect all residents while still providing an opportunity for individuality. Any changes to the code requires a public hearing where the residents have input. An Overlay Zone has been adopted on Route 5 to ensure the best possible development for the Town of Newstead. Currently, the rezoning of Route 5 has been tabled in order for the Town Board to meet with those property owners to discuss their concerns and to review the Comprehensive Master Plan.

The Zoning Board of Appeals meets when action is required. Items that are regulated by the zoning code can be amended through a variance process. An application must be completed, including a fee paid. Contact our office for details. Fees are listed in the Fee section of the home page.

    RA zone - 150' x 45,000 square feet
  • Setbacks from Road Right of Way:
    State Rd. - 65'
  • County Rd - 65'
  • Town Rd - 50'
  • Side lot Setbacks:
    10' minimum from side and rear lot lines except fences which can be placed on the lot line
  • Homes:
    Single family - 1,000 square feet
  • Two family - 750 square feet/unit

    2 acres for house and barn and one additional acre for every animal unit (1,000 lbs.)
