| Volunteer sought for state advisory committee |

A new volunteer is being sought from Oregon Congressional District 2 for the state’s Citizen Involvement Advisory Committee (CIAC). CIAC is an eight-person committee that advises the Oregon Land Conservation and Development Commission (LCDC) and local governments on citizen involvement in land use planning.
The committee meets every two months; usually in Salem.
CIAC’s work centers on Statewide Planning Goal 1: Citizen Involvement. The committee furthers the goal through activities such as:
- Writing materials to educate and inform Oregonians about citizen involvement;
- Gathering and disseminating information about citizen involvement techniques; and
- Advising LCDC and state and local officials about ways to enhance citizen involvement.

Completed applications must be received at DLCD by 5 p.m. on Friday, Oct. 31, 2008.

| Turiel named Oregon's Measure 49 Ombudsman |

SALEM – Alwin Turiel, a native Oregonian and veteran city and county land use planner, was named last week as Oregon’s Measure 49 Compensation and Conservation Ombudsman.
The ombudsman position is new – created by the passage of Measure 49 last fall. Turiel will focus on working with private landowners and local governments to resolve issues arising from Measure 37 and to help make Measure 49 work as intended – to provide limited relief to landowners unfairly affected by land use regulations on landowners. Her office is in Oregon’s Department of Land Conservation and Development (DLCD).
Turiel comes to DLCD after a stint as a planning consultant in Portland. Prior to that, she was planning director for Jackson County and then Klamath County. During her 27-year career she also has worked in the Portland metro area and on the Oregon coast. She’s also been a planner in four other states, including California and Florida.
Turiel received a master’s in urban planning from the University of Oregon, where she focused on regional economics, analytic modeling and land use planning. Her undergraduate degree is from the Art Institute of Chicago, where she studied design.
EDITOR'S NOTE: Turiel resigned from DLCD in July for another job opportunity. The department is now recruiting for a new Compensation and Conservation Ombudsman.

| Free guide to citizen involvement in planning now on the Internet |

SALEM – A publication that helps guide and promote citizen involvement in land use planning in Oregon has been updated and is available for free on the Internet.
The guide is called: Putting the People in Planning: A Primer on Public Participation in Planning. It is available on the Oregon Department of Land Conservation and Development’s website at: http://www.oregon.gov/LCD.
The guide has two main purposes:
- To help planners and local government officials carry out Oregon’s Statewide Planning Goal 1: Citizen Involvement; and
- To explain Goal 1 to non-planners, especially those who serve on citizen committees in cities and counties in Oregon.
The guide was first published in 1992 by the state’s Citizen Involvement Advisory Committee (CIAC). This third edition was rewritten by CIAC, an eight-member volunteer board, and Mitch Rohse, a land use consultant.

| State completes Measure 49 notice mail-out |

SALEM – The Oregon Department of Land Conservation and Development (DLCD) completed an 11-week process of mailing more than 10,000 Measure 49 information and election notice packets last Friday.
Oregon voters approved Measure 49 last November, modifying Measure 37, by replacing “waivers” of regulations with authorizations to establish a limited number of homesites.
The election notice packets were mailed out to property owners who had submitted claims to the state under Measure 37. The Measure 49 election notice provides claimants with three options with regard to residential claims: an express option (1-3 homesites), a conditional option (up to 10 homesites), and a vested option (common-law right to continue development).
Each claimant has 90 days, from the date of the individual mailing, to elect one of the options and return their form to the state. Now that the mailing process is complete, the department welcomes any Measure 37 claimant who has not received their packet to contact DLCD staff (see below).
“The efficiency with which we completed the mailing, and in turn are receiving completed forms back from claimants, bodes well for Measure 49 benefits being realized by Oregonians,” said Richard Whitman, Director of DLCD.

| State begins mailing Measure 49 notices |

SALEM – Oregon landowners who filed claims to the state for compensation under Measure 37 (2004) will begin receiving Measure 49 (2007) information in the mail this week. The Oregon Department of Land Conservation and Development (DLCD) began mailing out approximately 6,400 Measure 49 Election Notice Packets last Friday.
Measure 49 – passed by Oregon voters last November – modifies Measure 37, which waived regulations for property owners back to when they purchased the land.
The Measure 49 packets will be mailed out over the next three months. Only those who withdrew their Measure 37 claim will not receive a Measure 49 packet.
Measure 49 Election Notice Packets provide three options to those who have already filed Measure 37 claims to the state:
- An ‘Express Option’ allowing eligible claimants to develop up to three home sites;
- A ‘Conditional Option,’ which has more stringent requirements, allowing eligible claimants to develop up to 10 home sites; or
- A ‘Vested Option,’ which allows a Measure 37 claimant to proceed with his/her land development project if he/she incurred substantial costs in good faith to carry out a Measure 37 waiver.
Claimants have 90 days to elect one of the options and return their form to the state.
