The
Federal Mine Safety and Health Review Commission (FMSHRC) provides
administrative trial and appellate review of legal disputes arising under
the Federal Mine Safety and Health Amendments Act of 1977. It does not regulate
mining or enforce the Mine Act. The FMSHRC Website contains the following
information:
-
Rules provides Commission procedural rules, ethical conduct standards for
Commission employees, and enforcement of nondiscrimination in programs or
activities conducted by the Commission.
- FMSHRC also provides
Recent Decisions including Commission and Administrative Law Judges
(ALJ) decisions in pdf/html formats, plus a list of Commission cases pending
in the Court of Appeals or that have been decided this fiscal year.
Published Decisions contains Commission decisions and ALJ decisions
from 1995 to current in text/pdf or html/pdf format. The database is searchable or
browseable with documents arranged in chronological order from oldest to most
recent. Westlaw is another source of FMSHRC decisions beginning with 1979 (FLB-FMSHRC). In addition,
the Wirtz Labor Law Library has in its print collection the decisions dated August 1979 to December 2003.
