(a) The Midway Islands Court shall have jurisdiction over civil cases for the recovery of money only where the amount claimed does not exceed $500 exclusive of the interest and costs except as provided by Sec. 762.108. (b) The court's jurisdiction is further limited in that no such claim cognizable under paragraph (a) of this section shall be within the court's jurisdiction unless: (1) The claim arises or has arisen on the Midway Islands; (2) All plaintiffs and all defendants reside, at the time of trial, on the Midway Islands; and (3) The claim does not fall within the special maritime jurisdiction under the Act of June 15, 1950 (Chapter 253, 64 Stat. 217). [[Page 470]] (c) Actions shall be commenced and maintained in the Midway Islands Court under the procedures set out below and conducted in such a manner as to do substantial justice and equity between the parties. When acting on such actions, the court shall be termed the Small Claims Court.
