Summary of Law(s) and Regulation(s):
The state’s law may deny benefits if the employee's injury was due to intoxication from the use of alcohol or being impaired by illegal drugs. A positive drug test performed in accordance with the U.S. Dept. of Transportation's regulations is considered a conclusive presumption of intoxication. An employee's refusal to undergo a drug test also is a valid basis for denial of workers' compensation if the employer warns the employee, in writing, that such a refusal forfeits the employee's right to compensation under the law.
