SUBJECT: STAFF REQUIREMENTS - AFFIRMATION SESSION, 9:25 A.M., WEDNESDAY, MAY 3, 2000, COMMISSIONERS' CONFERENCE ROOM, ONE WHITE FLINT NORTH, ROCKVILLE, MARYLAND (OPEN TO PUBLIC ATTENDANCE)
I.    SECY-00-0057 - Final Rule: Revision of Part 50, Appendix K, "ECCS Evaluation Models

The Commission approved a final rule amending 10 CFR Part 50, Appendix K, "ECCS Evaluation Models" to facilitate small but cost-beneficial power uprates for some commercial nuclear power plants.

The Federal Register notice should be updated on page 13 to reflect the staff's issuance of the safety evaluation on the ABB Crossflow measuring system since this SECY paper was submitted to the Commission on March 3. The staff should continue, as directed by the SRM for SECY-99-014, to treat this as a major rule, and the Federal Register notice should be appropriately modified. Following incorporation of these changes, the Federal Register notice should be reviewed by the Rules Review and Directives Branch in the Office of Administration and forwarded to the Office of the Secretary for signature and publication.

The staff should revise the press release so that it clearly and orderly lays out: 1) what our current requirements are, 2) the impetus for the change, 3) how the revised rule affects licensees, and 4) why, from a safety perspective, the NRC is comfortable with the revised rule.

The staff should revise the Congressional letters so that the significance of the final rule is clearly conveyed.

The staff should review the standard review plan (NUREG-0800) to evaluate the impact of the revised rule on non-LOCA safety analyses.

II.    Secy-00-0068 GPU Nuclear, Inc., Docket No. 50-219-LT; Petition to Intervene

The Commission approved a Memorandum and Order responding to a petition submitted by Nuclear Information and Resource Service (NIRS) to intervene in the license transfer application for the Oyster Creek Nuclear Generating Station.

The Memorandum and Order concludes that NIRS has demonstrated standing; that NIRS's issues are not admissible; denies NIRS's request for hearing and petition to intervene; and terminates the proceeding.

(Subsequently, on May 3, 2000, the Secretary signed the Memorandum and Order.)

II.    SECY-00-0069 - Moab Mill Reclamation Trust, Docket No. 40-3453-LT; Petition to Intervene

The Commission approved a Memorandum and Order responding to Mr. John F. Darke's request for a hearing. The Memorandum and Order denies Mr. Darke's request for a hearing and terminates the proceeding.

(Subsequently, on May 3, 2000, the Secretary signed the Memorandum and Order.)
