Anteon Corporation Agrees to Pay 34 Fort Wainwright Workers a Total of $110,005

FT. WAINWRIGHT, Alaska -- Anteon Corporation, a government contractor based in Fairfax, Va., has agreed to pay 34 employees at its Ft.Wainwright facility a total of $110,005 after an investigation conducted by the U.S. Department of Labor found violations of the McNamara-O’Hara Service Contract Act (SCA) and the Fair Labor Standards Act (FLSA).

According to Donna Hart, district director for the Department of Labor’s Wage Hour Division in Seattle, the workers were service contract employees in administrative positions at the Battle Simulation Training Center preparing soldiers for combat. The functional analyst and training specialists at Ft. Wainwright were misclassified as exempt under the laws, and as a result were not paid proper wages, fringe benefits and overtime premium pay, Hart said.

For the FLSA violations, the complaint was filed and consent findings were signed in the U.S. District Court of Alaska at Anchorage, while the complaint and stipulated consent findings for violations under the SCA were filed with the U.S. Labor Department's Office of Administrative Law Judges.

Under the SCA, contractors and subcontractors on federal service contracts over $2,500 must pay their service workers no less than the wages and fringe benefits prevailing in the locality. The Labor Department issues wage determinations that provide the required SCA wage rate and fringe benefits for each service occupation. These determinations are incorporated into covered federal contracts.

Under the FLSA, covered workers must be paid the federal minimum wage for all hours worked and at least time and a half for all hours worked over 40 in one workweek.
