U.S. Labor Dept. Recovers $178,000 for Nevada Mine Workers

221 Workers Receive Back Wages For Overtime

SAN FRANCISCO -- Dynatec Corporation USA, a Utah based mining company, has paid $178,495 in back wages to 221 employees following an investigation by the U.S. Department of Labor (DOL). The department's Wage and Hour Division found that the company miscalculated the overtime wages earned by workers.

"The Department of Labor is committed to strong enforcement of the laws to ensure that all workers are paid the correct wage for all hours worked," said Tammy D. McCutchen, administrator of the Wage and Hour Division. "We are pleased that these workers have received the $178,000 in overtime wages they worked hard for and deserve."

The federal investigation determined that Dynatec Corporation USA, headquartered in Salt Lake City and operating in Carlin and Midas, Nevada, incorrectly calculated overtime wages for workers who routinely worked as many as 70 hours per week.

The Fair Labor Standards Act (FLSA) requires that employees be paid one-and-one-half times their regular rate of pay for hours worked over 40 per week. Dynatec did pay workers one and one-half times their regular hourly pay for excess work hours, but failed to add the substantial production bonuses which workers routinely earned to the base pay before making the calculations. The resulting shortfall was $178,495.

The back wages will compensate 221 miners and mechanics for work performed during the two-year period ending November 22, 2002. All employees have been paid in full.
