USDA - FOREST SERVICE
BLACK HILLS NATIONAL FOREST
OCCUPANCY AND USE RESTRICTION
Pursuant to 36 CFR, Section 261.50(a) the following act is prohibited
until rescinded on the area described in this order and as shown on the
map attachments and hereby incorporated into Exhibit
A, within the Black
Hills National Forest.

These prohibitions apply to the area that is commonly known as Little
Elk Creek Canyon and include the area within one half mile of the Little
Elk Creek road from where the road enters national forest administered
lands.
This prohibition is enacted for public safety and the protection of property.
Pursuant to 36 CFR, Section 261.50(e), the following persons are exempt
from this order:
- Any person with a valid South Dakota hunting license when in the
pursuit of a game animal during an open hunting season.
- Persons with a permit specifically authorizing the otherwise prohibited
act or omission.
- Any Federal, State, or local officer, or member of an organized
rescue organization in the performance of an official duty.

Violation of these prohibitions is punishable by a fine of not more than
$5,000 for and individual or $10,000 for an organization, or imprisonment
for not more than six (6) months, or both. (Title 16 U.S.C. 551 and 18
