I. OVERVIEW OF CERTIFICATION AND
CONFORMITY ASSESSMENT SYSTEM
1. Regulatory Agencies and their functions
The Agency
for Standardization, Metrology and Certification of Uzbekistan (“Uzstandard”
Agency) is the key regulatory
agency in Uzbekistan on the matters of Standardization, Metrology and
Certification. According to the resolution of the Cabinet of Ministers of
Uzbekistan № 373 of August 5, 2004, the main objectives of the Uzstandard
are:
To achieve the objectives related to
certification process “Uzstandard” fulfills following functions:

Implements state policy in the field of certification;
·
Establishes general rules and the order for certification of products,
services, systems for monitoring of quality in compliance with international
norms and standards;
·
Works out proposals for further improvement of the system of certification in
Uzbekistan and presents them for consideration to the Cabinet of Ministers of
the Republic of Uzbekistan;
·
In conformity with the Cabinet of Ministers of the Republic of Uzbekistan takes
decisions regarding joining international certification systems and also
concludes agreements for the mutual acknowledgement of the certification
results;
·
Represents the Republic of Uzbekistan in the mutual relations with the other
states and also in the international organizations on certification matters;
·
In conformity with the Cabinet of Ministers of the Republic of Uzbekistan
determines the list of products subject to obligatory certification;
· Accredits bodies certifying homogenous products, testing laboratories (centers), supervising bodies in the area of certification and experts-auditors on quality;
·
Provides guidance for the National certification System of the Republic of
Uzbekistan;
·
Exercises state monitoring over observance of the legislation related to
mandatory certification of the products, works and services;
·
Maintains State Register of the Certification System for homogeneous products,
certified products, systems for controlling quality;
· Cancels and suspends certificates of conformity and marks of conformity, cancels licenses accreditation of certification bodies, ceases the work of testing laboratories for breaking the rules of certification.
Agency “Uzstandard” fulfills its
objectives and functions directly and through its regional departments as well
as other organizations and institutions under its authority. The activities of
“Uzstandard” are financed by the state budget and fees that the agency charges
for its services.

3. Mandatory Certification vs. Voluntary
Declaration of Conformity
Decree of the Cabinet of Ministers of Uzbekistan N0 318 defines a
list of products subject to mandatory certification, as well as those which
compliance can be confirmed with the declaration of conformity.

Any product can be
subjected to voluntary certification under the initiative of a legal entity and
private individual to assure its conformity to the requirements of normative
documents. The legal entities and private individuals, accredited in the order
established by Uzstandard have the right to conduct voluntary certification.
The voluntary certification systems, determining the rules and order of
certification can be established by accredited bodies as agreed upon with
Uzstandard.
4. Effect of international certification/standardization
laws and regulations on Uzbekistan certification system
During recent years
Uzbekistan has made considerable progress in harmonization of technical
standards with the rules and principles of the WTO. However,
the current legal
system entails excessive number of mandatory requirements and regulations regarding
the quality of products and services, which according to the WTO rules can
potentially create technical barriers for exports from foreign countries,
raises concerns. Moreover, the
lack of application of international standards quality certification
requirements substantially slows down the development of potentially strong
export industries of Uzbekistan. According to Uzbek legislation, if the
international treaty or agreement establishes other rules, than stipulated by
the legislation on certification, the rules of the international treaty or
agreement should be used.
Uzbekistan has signed international agreements on recognition of certificates of conformity with:
- Turkey
- States-members of CIS (Commonwealth of Independent States in the framework of multilateral agreement on conducting coordinated policy in the area of standardization, metrology, and certification, dated by March 13, 1992.
5. Brief overview of Standardization and
Accreditation Systems as relates to Certification and Conformity Assessment
processes
Uzstandard plays an important role in
functioning standardization and accreditation systems as these relate to
certification and conformity assessment processes too:
II. CERTIFICATION PROCESS BASED ON COMMODITY
TYPE
1. Certificate of Conformity
Registration of the certificate of conformity is carried out by
certification bodies.
The applicant may independently choose a certification body. At any
moment, the applicant has the right to request, and certification bodies are
obliged to give under the first requirement the following documents:
a) The list or an extract from the list of kinds of products subject to
mandatory certification of conformity;
b) Rules of similar product certification covered by its sphere of
accreditation;
c) The price-list (tariffs) for certification services;
d) The document confirming accreditation with the authorized state body.
For registering the certificate of conformity on a manufactured product,
the applicant should file an application to the certification body. The
following documents should be attached to application:
The following documents are needed for certification of imported
products:
For the purposes of certification, the official copies of normative
documents on standardization, certified with the “Uzstandard” agency, should be
submitted to certification bodies; in other cases, including for own needs,
there can be used not certified copies.
If it is requested in the application, the certification body may begin
certification works with even without a copy of the hygienic certificate
(veterinary and phytosanitary conclusions). In this case, the certification
body has the right to issue the certificate of conformity only after submission
of all the necessary copies of documents with positive conclusions. In a
two-day time from the date of submission of the application, the certification
body should visit the site and take samples and identify them to carry out
certification tests. The number of samples, the order of sampling, the rules of
identification and storage are established in the normative documents for the
product.
The applicant has the right to be present when sampling and testing of
the product takes place. Thus, the laboratory shall take confidentiality
measures. Responsibility for the storage, quality and reliability of testing
the samples shall be born by the laboratory (center) accredited with the
“Uzstandard”. Test protocols should be signed by responsible experts and
approved by the head of the laboratory.
The applicant may submit to the certification body additional documents
about the product testing in accredited laboratories. If the product has been
tested under separate parameters in different testing laboratories, the
availability of all necessary reports with the positive results of testing is
considered as a positive assessment of the product conformity to applicable
requirements.
In case of non-existence in Uzbekistan of the normative documents on the
imported products subject to mandatory certification, the certification tests
under quality and safety parameters should be carried out in conformity with
requirements for similar kinds of products. If an applicant has not submitted a
necessary normative document or safety characteristics on the imported product,
the certification of the given product should be carried out according to
procedures for similar kinds of products or on the basis of the hygienic
certificate.
Negative results of laboratory tests, as well as submission of an
incomplete set of documents are the basis for refusal in issuing the
certificate of conformity. However, the certification body should inform the
applicant about refusal in written form with reference to the concrete norms of
legislation. The applicant can appeal against refusal according to existing
order.
According to legislation, on the basis of submitted documents and
positive test results, the certification body should issue a certificate of
conformity within two working days. The certificate of conformity should be
issued for the imported product for the term of the product’s warranty period,
and for a serially made product - for 3 years.
To issue the certificate of conformity for serially manufactured
products, the certification body with the aim of attesting availability of
conditions for serial production of the product shall inspect the facilities
for production. As a result of this inspection the certification body writes a
report to be used in making decision whether to issue the certificate of
conformity. The inspection period shouldn’t exceed 10 working days from the
moment of sampling for tests. A fee is charged for carrying out the inspection,
the amount of which depends on the time actually spent and other relevant
charges/expenses.
The certificate of conformity for these types of products should be within
5 working days from the moment the certification body receives the results of
the inspection. The certifications body, which issued the certificate of
conformity on a serially made product, should conduct inspections of the
certified product not less than once a year with the aim of assuring its
conformity to the requirements established at certification.
The order of payment for laboratory tests, registration and issuance of
the certificate of conformity, the amount of license deductions is set by “Uzstandard”
agency in coordination with the Ministry of Finance.

2. Hygienic, Phytosanitary and Ecological Certificates
Hygienic, veterinary, phytosanitary and ecological certificates
(conclusions) should be issued in cases when there are hygienic, veterinary,
phytosanitary or ecological requirements for the products to be certified.
To receive the hygienic certificate, the applicant should file an
application to the territorial body of State Sanitary Supervision. A copy of the
normative document for the manufactured product should be attached to the
application (this could be an interstate standard - GOST, Uzbekistan’s state
standard - ОzDSt, technical specifications - ТSh; for foodstuff - a
technological instruction and a recipe approved by the Ministry of Health of
Uzbekistan). To receive the hygienic certificate for an imported product, an
applicant should additionally submit copies of the following documents:

A copy of the
shipping documentation with information regarding arrival of the goods into
customs territory of the Republic of Uzbekistan (a commodity-transport waybill,
invoice, bill).
·
Certificate of
origin (in cases when there is no reliable proof of origin of goods).
In cases of production or import of products related to application new
(not tested earlier) food additives,
special biologically active substances or production technologies designed to
produce food raw materials and foodstuffs, the territorial body of state
sanitary supervision should request a special permit from Ministry of Health of
Uzbekistan. The Ministry of Health of the Republic of Uzbekistan should issue
permit within 3 working days. A fee not exceeding the amount of 10 minimal
monthly wages to compensate expenses related to carrying out of laboratory
tests will be levied.
After the analysis of submitted documents, the territorial body of state
sanitary supervision should take samples of the product for laboratory testing
and inspecting the product by making site visit. Product tests for finding out
hygienic parameters are to be carried out by the laboratories of territorial
bodies of State Sanitary Supervision accredited with Uzbekistan’s national
accreditation system.
In case of the animal or vegetable product, the territorial body of State
Sanitary Supervision not later the next day from the date of reception of
documents from the applicant should refer to the authorized bodies on issuance
of veterinary or phytosanitary conclusions. The veterinary or phytosanitary
conclusion is issued by the regional (city) bodies of State Veterinary
Supervision or the bodies of the State Service for Plant Quarantine. The body
of state veterinary supervision has the right to issue the
isolation-restrictive actions (quarantine) for the period up to 20 days. Thus,
the procedure of issuing the veterinary conclusion should be suspended until
the termination of the quarantine term. According to legislation, the
preparation and issuance of veterinary or phytosanitary conclusion should not
take more than three working days. A fee not exceeding the amount of 1 minimal
monthly wage to compensate expenses related to issuance veterinary or
phytosanitary certificate will be levied.
The Uzbek legislation says that registration and issuance of the hygienic
certificate, including the receipt of veterinary and phytosanitary conclusions,
should not take more than 14 working days. A fee not exceeding the amount of 10
minimal monthly wages to compensate expenses related issuance of hygienic will
be levied by suing the by the territorial bodies of State Sanitary Supervision.
Hygienic certificates for manufactured products are valid for 3 years.
The term validity of hygienic certificate on an imported product coincides with
product’s expiry date.
The accredited laboratories are not allowed to carry out the duplicating
tests. Refusal in issuing the hygienic certificate or the phytosanitary and
veterinary conclusions can be appealed against by the applicant in a prescribed
order.
III. WHAT TO EXPECT DURING CERTIFICATION PROCESS
The procedure of certification for each kind of
similar products is defined by the corresponding certification rules registered
with the Ministry of Justice of Uzbekistan.
A change of product design or
external characteristics which are not influencing the safety characteristics
attested during earlier certification process, does not entail an additional
certification.
Certification should be carried out, as a rule, in two stages. The first
stage includes registration of the hygienic certificate in the bodies of State
Sanitary Supervision, accredited with the "Uzstandard” agency, with simultaneous registration (in case if this
is needed) of veterinary and phytosanitary conclusions with the bodies of State
Veterinary Supervision and the State Service for Plant Quarantine. Thus, a
legal entity or individual applying for certification has the right:
The second stage consists of the issuance of the certificate of
conformity by certification bodies.
After receipt of written application of entrepreneurs, certification
bodies have the right to render agency services on certification and obtaining
all necessary certificates/conclusions from the bodies of State Sanitary
Supervision, at the bodies of State Veterinary Supervision and the State

Thus, certification bodies shall bear responsibility, as well as
liability for the correctness of sampling and their submission to the
corresponding state bodies. The deadline for registration and issuance of the
certificate of conformity is set from 10 working days to 1 month from the
moment of submission of all the necessary documents depending on a degree of
complexity, labor intensiveness and peculiarities of testing procedures.

Certification works on
the homogeneous product certification are executed by the Republican Center for Testing and
Certification with territorial subdivisions and more than 70 accredited bodies. The Department of the
Technical Policy in the field of the conformance acknowledgement
performs coordination and general guidance of the work in the field of
certification.
