U.S. Dept. of Labor Recovers $70,000 for Fresno Roofing Workers

87 Workers Receive Back Wages For Overtime

SAN FRANCISCO -- "The Department of Labor is committed to strong enforcement of the law to ensure that all workers, particularly those in low-wage jobs, are paid the correct wage and for all hours worked," said George Friday, regional administrator of the Wage and Hour Division. "We are pleased that these workers have received the $70,000 in overtime wages."

The federal investigation determined that Fresno Roofing Company, with offices at 5950 E. Olive Ave., paid roofing installers and some maintenance employees straight hourly pay regardless of the number of hours worked. In addition, an office manager, two secretaries and a yard supervisor were misclassified as salaried workers and exempt from overtime pay.

The FLSA requires employees be paid the federal minimum wage of $5.15 per hour for all hours worked and one-and-one-half times their regular rate of pay for hours worked over 40 per week. In addition, employers must maintain accurate time and payroll records. Employers must also comply with state minimum wage and overtime laws.

The back wages will compensate the mostly Hispanic male employees for work performed during the two-year period ending December 5, 2002. All employees have been paid in full.
