Portland and Beaverton Restaurant Operator Agrees To Pay 19 Workers a Total of $11,840

PORTLAND, Ore. -- Nineteen employees of three restaurants operated by Sandoval Mexican Restaurants, Inc. in Portland and Beaverton will receive a total of $11,840 owed to them in back pay and interest under a federal consent judgment, the U.S. Department of Labor’s Wage and Hour Division announced today.

The settlement includes an agreement by the companies to correct violations of the minimum wage, overtime pay and recordkeeping provisions of the federal Fair Labor Standards Act (FLSA). Daniel Sandoval, the owner, also agreed to the entry of the consent judgment, which prohibits him from future violations of the FLSA and orders the back wage payments.

The complaint was filed and the consent findings were signed in the U.S. District Court in Portland.

According to Bonny Crosby, assistant district director for the department’s Wage Hour Division in Portland, the workers were low-wage cooks and dishwashers at three restaurants in Portland and Beaverton who were not paid minimum wage or overtime pay for hours more than 40 per week.

The Fair Labor Standards Act requires that employers pay covered workers at least the federal minimum wage and one-and one half times their regular rates of pay for all hours worked more than 40 in a single workweek, unless otherwise exempt. Employers must also maintain accurate records of employees’ wages, hours and other conditions of employment.
