U.S. Department of Labor Recovers $125,247 in Back Wages for Plano Commercial Painters

DALLAS -- The Sedaker Group LLC, Plano, Texas, has agreed to pay 99 present and former painters and office employees $125,247 in back wages as a result of violations of the Fair Labor Standards Act (FLSA), the U.S. Department of Labor announced.

“The Labor Department is committed to ensuring that workers are paid their full wages, including any overtime wages earned,” said Cynthia Watson, Wage and Hour regional administrator in Dallas. “Although the Sedaker Group had come into compliance with the law by the time Wage and Hour began its investigation, there was a period of a year and a half when workers were not paid their full wages.”

An investigation by the Labor Department’s Wage and Hour Division, covering the two years from June 2002 to June 2004, found that, except for the last six months of that time period, the company violated the overtime provisions of the FLSA.

The Sedaker Group, which does commercial painting throughout the Dallas and Fort Worth Metroplex, has agreed to fully comply with the FLSA in the future and to pay the back wages due by October 2006.

The FLSA, enforced by the Wage and Hour Division, requires employers to pay covered employees the minimum wage for all hours worked and time and one-half their regular rate of pay for hours worked over 40 per week. The FLSA also requires employers to maintain accurate time and payroll records and places restrictions on employment of minors under 18 years of age.
