U.S. Labor Department Files Suit Against Greer’s Investigations and Security in Dallas to Recover $98,592 in Back Wages

DALLAS, TX -- The U.S. Department of Labor today announced the filing of a lawsuit against Greer’s Investigations and Security Inc. and Billy G. Greer, owner and president of the company, in Dallas, Texas, for failing to pay 59 former and current security guards $98,592 in overtime pay.

The complaint, alleging violation of the overtime provisions of the Fair Labor Standards Act (FLSA), was filed in the U.S. District Court for the Northern District of Texas following an investigation by the department’s Wage and Hour Division in Dallas.

“This employer failed to pay employees overtime pay for hours worked over 40 in a workweek,” said Cynthia Watson, Wage and Hour regional administrator in Dallas. “If employees work overtime hours, they must be paid time and one-half their regular rate of pay for those hours.”

In addition to seeking back overtime wages, the complaint asks for an injunction restraining Greer’s from future violations of the FLSA.

The FLSA requires that covered employees be paid the minimum wage for all hours worked and time-and-one-half their regular rate of pay for hours worked over 40 per week. The FLSA also requires employers to maintain accurate time and payroll records.

Greer’s Investigations and Security provides security guard and patrol services throughout the Dallas-Fort Worth Metroplex.

In fiscal year 2004, the Wage and Hour Division recovered nearly $200 million in back wages for more than 288,000 workers. Average days to resolve a complaint decreased in fiscal 2004 from 108 to 92 days.
