U.S. Labor Department Recovers $115,398 in Back Pay for Janitorial Workers in Fort Worth

FORT WORTH, TX -- CTJ Maintenance Inc., Fort Worth, Texas, has agreed to pay $115,398 in back wages after an investigation by the U.S. Department of Labor’s Wage and Hour Division found that 34 janitorial workers had not been properly paid.

CTJ Maintenance had a government contract with the Army and Air Force Exchange Service to provide janitorial services to the Naval Air Station Reserve Base in Fort Worth. Under the contract, the company failed to pay its workers minimum wage plus health and welfare benefits and vacation and holiday pay as required by the Service Contract Act (SCA).

Additionally, the contract was subject to the provisions of the Contract Work Hours and Safety Standards Act which requires payment at time-and-one-half the regular rate for hours worked in excess of 40 in a workweek. The employer paid straight time only for all hours worked.

“The Department of Labor will continue to enforce the law to ensure that all workers are paid their full wages for work performed,” said Cynthia Watson, wage and hour regional administrator in Dallas.

The SCA requires that every federal service contract in excess of $2,500 contain a wage determination reflecting wages and fringe benefits prevailing in the locality or contained in the collective bargaining agreement of the predecessor contractor.

CTJ Maintenance, which employs about 63 workers, cooperated with the investigation and has agreed to future compliance. All back wages due have been paid in full by the company.

The Wage and Hour Division recovered nearly $200 million in back wages in fiscal year 2004 for more than 288,000 workers. Average days to resolve a complaint decreased in fiscal 2004 from 108 days to 92 days.
