U.S. Department of Labor Recovers $184,676 in Back Wages123 Dallas-area Workers Get Earned Overtime Pay from Trucking CompaniesDALLAS -- Tomas Reyes Trucking and Reyes Brothers Trucking in Dallas have paid $184,676 in back wages after an investigation by the U.S. Department of Labor’s Wage and Hour Division found that 123 current and former truck drivers, mechanics, dispatchers and office staff were improperly paid. “Employees are entitled to the wages they have earned,” said Cynthia Watson, Wage and Hour southwest regional administrator. “These companies did not pay their employees additional half-time for overtime hours worked. This is unacceptable.” The investigation determined that Tomas Reyes Trucking and Reyes Brothers Trucking failed to pay overtime to employees who did not meet exemption requirements, violating the provisions of the Fair Labor Standards Act (FLSA). Additionally, the required time and payroll records were not maintained. The FLSA requires covered employees to be paid the minimum wage for all hours worked and time-and-one-half their regular rate of pay for hours worked over 40 per week. Employers must also maintain accurate time and payroll records. Both trucking companies, which are engaged in hauling debris at construction sites in the Metroplex, cooperated with the investigation and have agreed to comply with the FLSA in the future. All back wages have been paid in full.
