The Regional Judicial Officers (RJO) have adjudicatory functions under: the Consolidated Rules of Practice, 40 CFR Part 22 (pdf, 130K), Hearings on Interim Status Corrective Action Orders, 40 CFR Part 24; and several other statutes administered by the Agency.

Under the Consolidated Rules of Practice, the Regional Judicial Officer’s Presiding Officer functions are bifurcated between the Administrative Procedure Act (“APA”) and the non-APA provisions of the Rule. In proceedings subject to APA hearings, the Regional Judicial Officer serves as the Presiding Officer before an answer is filed in a proceeding. Non-APA proceedings are covered by Subpart I of the Consolidated Rules. Under Subpart I the Regional Judicial Officer serves as Presiding Officer throughout a proceeding.
