RFG and Oxygenate Waiver Requests

Under the Clean Air Act (CAA), nine cities with the worst smog pollution were required to use reformulated gasoline (RFG). In addition, areas reclassified to “severe” or “extreme” non-attainment are required to begin using reformulated gasoline. Non-attainment areas that are classified as “moderate” or “marginal” may opt-in to the RFG program. The CAA also requires that RFG contain a 2 percent oxygenate. EPA has the discretion to grant waivers to areas to exempt them from certain oxygenate requirements. EPA received petitions from California, New York, Connecticut and Louisiana to waive the oxygenate requirement. EPA reviewed and denied California, New York and Connecticut’s requests. EPA also received petitions from Georgia and Louisiana to waive the entire RFG program. EPA reviewed and denied Georgia and Louisiana's requests and was sued. The Georgia case is in litigation and a decision on remand for Louisiana is pending with EPA.
