Rules to review before calling:

Motions Without Argument: Local Rule 7(b); Trial Continuances: Local Rule 40; Summary Judgment: Local Rule 56 and Civil Rule 56.

Change of case assignment, consolidation of cases, and show cause hearing confirmation inquiries should be directed to the Chief Civil Department.

HEARING REQUESTS

Requests for hearing dates are accepted by e-mail.  E-mail the bailiff at mattson.court@kingcounty.gov.  Motions for Summary Judgment and all other civil motions with oral argument are heard on Fridays only; civil motions without oral argument may be set for any court day which meets service requirements of the rule.  E-mail must include the following information:

  • Case name and cause number
  • Type of motion/hearing
  • Moving party, name of counsel and counsel's phone number
  • Proposed dates

SUMMARY JUDGMENT MOTIONS

The moving party is required to make note of the following information and communicate this information to the opposing party/parties as well:

  • Pertinent parts of deposition transcripts and other exhibits/attachments accompanying the motion and responsive papers must be highlighted.
  • The court must be provided with copies of all cited out-of-state and federal cases.
  • Notification to strike the hearing must be done in writing (via email or fax) at least 3 days prior to the hearing if at all possible.
  • The court will not allow cross motions or additional related motions with oral argument without prior approval.

TRIAL PREPARATION

  • Status conferences, CR 16 conferences, or pre-trial conferences will be scheduled upon request of the parties and approval of the court.
  • Pre-trial orders will be sent prior to the trial date.  Please refer to the order regarding exhibits, jury instructions, trial briefs, and pre-trial motions.
  • Cases will be put on standby status 2 court days prior to the trial date until reassigned to an available judge.  The bailiff will contact you with updates or you may check the Superior Court Homepage.
  • The bailiff will give standby parties a 2-hour advance notice (at least) of when and where to appear for trial.  Cases may be sent to Seattle if a Seattle court becomes available before a Kent court.
  • Please notify the court immediately if there are issues affecting your trial such as witness availability, interpreter needs, scheduling issues or other special needs.
  • Cases which have not submitted the “Joint Confirmation Regarding Trial Readiness” will be given lower priority on the standby list.
  • Notify the court immediately via email if a case settles so the trial date may be stricken.

GENERAL INFORMATION

  • Please do not confirm motions without oral argument.
  • All working papers should be mailed or delivered directly to the judges' mailroom, Room 2D.  Please do not deliver to the courtroom (without prior arrangement with the bailiff) as it disrupts court proceedings.  Papers may be faxed or emailed in some instances but only upon prior approval of the court.
  • Requests for oral argument on motions without oral argument must be requested in the pleadings.  The judge will review the motion on the date noted, and if further argument is necessary, the bailiff will contact the parties to schedule a hearing.
  • Stipulated or agreed motions do not need to be noted for hearing.
  • Notify the bailiff via email to strike a motion.
  • Copies of orders will not be mailed if envelopes are not provided per KCLR 7.
  • Motions not in compliance with local rules will be stricken without prejudice.
  • A party making a motion to shorten time must provide correct fax numbers for all parties in the notice of motion shortening time.  The underlying motion that is the subject of the motion for shortened time must accompany the motion shortening time.
  • ALL motions should include proof of service.  If no proof of service is included, the motion may not be considered.
  • Motions and stipulated motions to continue trial dates must be signed by the moving party/parties, as well as the party’s attorney.  Stipulated motions to continue the trial date made beyond the cutoff date must also include the basis for the request.
