Fire, NM

AGENCY: Federal Aviation Administration (FAA), DOT.

ACTION: Final rule.

-----------------------------------------------------------------------

necessary. The intended effect of this proposal is to provide adequate
controlled airspace for aircraft operating in the vicinity of Angel
Fire Airport, Angel Fire, NM.

SUPPLEMENTARY INFORMATION:

History

On August 29, 2001, a proposal to amend 14 CFR Part 71 to establish
Class E airspace at Angel Fire Airport, Angel Fire, NM, was published
in the Federal Register (66 FR 45660). The proposal was to establish
Class E airspace at Angel Fire Airport, Angel Fire, NM. The development
of a RNAV GPS SIAP to Angel Fire Airport, Angel Fire, NM, has made this
rule necessary. The intended effect of this proposal is to provide
adequate controlled airspace for aircraft operating in the vicinity of
Angel Fire Airport, Angel Fire, NM.
Interested parties were invited to participate in this rulemaking
proceeding by submitting written comments on the proposal to the FAA.
No comments to the proposal were received. The rule is adopted as
proposed, with the exception of minor editorial changes.
The coordinates for this airspace docket are based on North
American Datum 83. Designated Class E airspace areas are published in
paragraph 6005 of FAA Order 7400.9K, dated August 31, 2002, and
effective September 16, 2002, which is incorporated by reference in 14
CFR 71.1 The Class E airspace designations listed in this document will
be published subsequently in the order.

The Rule

This amendment to 14 CFR Part 71 establishes airspace extending
upward from 700 feet above the surface within a 7.5-mile radius of
Angel Fire Airport and within 2 miles either side of the 005[deg]
bearing from the airport extending from the 7.5-mile radius to 11.1
miles north of the airport.
The regulations adopted herein will not have substantial direct
effects on the States, on the relationship between the national
government and the States, or on the distribution of power and
responsibilities among the various levels of government. Therefore, it
is determined that this final rule will not have federalism
implications under Executive Order 13132.
Further, the FAA has determined that this regulation only involves
an established body of technical regulations that require frequent and
routine amendments to keep them operationally current. It, therefore,
(1) is not a ``significant regulatory action'' under Executive Order
12866; (2) is not a ``significant rule'' under DOT Regulatory Policies
and Procedures (44 FR 11034; February 26, 1979); and (3) does not
warrant preparation of a regulatory evaluation as the anticipated
impact is so minimal. Since this is a routine matter that will only
affect air traffic procedures and air navigation, it is certified that
this rule will not have a significant economic impact on a substantial
number of small entities under the criteria of the Regulatory
Flexibility Act.
