LOUISVILLE MAN CHARGED WITH POSSESSION OF A FIREARM AFTER BEING CONVICTED OF A FELONY
– Indictment alleges possession of a hi-point pistol, prior felony assault conviction

LOUISVILLE, KY - A federal grand jury in Louisville returned an indictment against Bryent Miller, age 28, of Louisville, Kentucky, in Jefferson County, on charges of possession of a firearm after he had been convicted of a felony, U.S. Attorney David L. Huber of the Western District of Kentucky, and Paul Vido, Special Agent in Charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Louisville Field Division, jointly announced today.

The Indictment alleges that on May 28, 2008, Miller possessed a Hi-Point 9millimeter semiautomatic pistol after he had been convicted of a felony. According to the Indictment, Miller was convicted of assault under extreme emotional disturbance in the Circuit Court of Jefferson County , Kentucky, on July 27, 2004. The indictment grew out of special operations conducted by the Louisville Metro Police.

In the event of a conviction, the maximum potential penalties are 10 years imprisonment, a $250,000 fine, and supervised release for a period of 3 years.

The case is being prosecuted by Assistant United States Attorney Thomas W. Dyke. The Louisville Field Office of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) conducted the investigation in partnership with the Louisville Metropolitan Police Department, as part of ATF’s mission to reduce violent crime and other threats to public safety.

This is a Project Backfire prosecution. Project Backfire is a cooperative effort by the Jefferson County Attorney’s Office, the Jefferson County Commonwealth’s Attorneys Office, the Louisville Metro Police Department, the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the United States Attorney’s Office to ensure that firearm offenses are prosecuted to the fullest extent of the state and federal law.

Miller is scheduled to appear for arraignment before the United States Magistrate Judge on September 16, 2008, at 9:30 a.m., in Louisville, Kentucky.

only and that person is presumed innocent until and unless
proven guilty.
