Davenport Man Sentenced To Maximum Sentence On Federal Child Pornography Charges

DAVENPORT, IA - On September 16, 2008, Donald Gene Colbert, age 55, of Davenport, Iowa was sentenced by United States District Court Judge John A. Jarvey to the statutory maximum 120 months in federal prison after pleading guilty to possession of child pornography, announced United States Attorney Matthew G. Whitaker. After serving his sentence, Colbert will be on supervised release for the rest of his natural life, including a requirement that he properly register as a sex offender. Colbert was also order to pay an assessment of $100 to the Crime Victim Fund.


Colbert was arrested on June 7, 2006 and pled guilty on May 14, 2007. In determining the guideline sentencing range, the district court found that Colbert had caused and permitted a minor to engage in sexually explicit conduct for the purpose of producing a visual depiction of this conduct, and eligible for enhancements based on the fact the offense involved images of minors between 12 and 16 years old, possession of images that portrayed sadistic or masochistic conduct or other depictions of violence, and use of a computer.


This case was prosecuted in the United States Attorney’s Office in the Southern District of Iowa as part of the Project Safe Child initiative. This investigation was conducted by the United States Secret Service and the Davenport Police Department.
