NEW ORLEANS MAN INDICTED FOR CRIMES RELATED TO OVERDOSE DEATH

HENRY DEEB GABRIEL, III, age (23), a resident of New Orleans, Louisiana, was charged in a Superseding Indictment with conspiring with other known individuals to distribute quantities of heroin and cocaine hydrochloride (Count One). GABRIEL was also charged with distribution of a quantity of heroin that led to the death of Madeleine Prevost (Count Two) as well as distributing the heroin to Ms. Prevost when she was under twenty-one years of age (Count Three), announced U. S. Attorney Jim Letten.

GABRIEL was arrested on March 12, 2008 pursuant to a federal criminal complaint. He is the fourth person charged in this investigation. Diego A. Perez and David C. Battenberg are scheduled for trial on July 7, 2008. Clinton Rodriguez is scheduled for trial on April 28, 2008

The charges followed an investigation by the Federal Bureau of Investigation that was initiated following the overdose death of a Ms. Prevost, a 16 year old female in January, 2008. During the investigation, agents obtained numerous text messages from the cellular telephones of GABRIEL and Perez which detailed Perez’s acquisition of heroin for GABRIEL that was later distributed to Ms. Prevost.

If convicted, GABRIEL faces a maximum term of imprisonment of twenty (20) years, a fine of up to $1,000,000 and three (3) years of supervised release following any term of imprisonment as to the drug conspiracy charge (Count One); a sentence of no less than twenty (20) years imprisonment up to life imprisonment, a fine of up to $1,000,000 and three (3) years of supervised release following any term of imprisonment as to the drug distribution charge that led to Ms. Prevost’s death (Count Two); and a sentence with a minimum term of imprisonment of one year and a maximum of forty (40) years imprisonment, a fine of up to $1,000,000 and six (6) years of supervised release following any term of imprisonment as to the distribution of heroin to a person under twenty-one years of age (Count Three).

U. S. Attorney Letten reiterated that the Indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case was investigated by the Federal Bureau of Investigation. U. S. Attorney Letten reiterated that the Indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case is being prosecuted by Assistant U. S. Attorneys William J. Quinlan, Jr. and Maurice Landrieu.
