March 14, 2008

FOR IMMEDIATE RELEASE

AKSHAYA SWAIN, 29, of Columbia, Missouri, was arrested for using a facility of Interstate Commerce to enticing a minor for unlawful sexual activity, announced U. S. Attorney Jim Letten.

According to documents filed in federal court, it is alleged that SWAIN knowingly used a computer and a cell phone to entice a fifteen year old girl to engage in unlawful sexual activity with SWAIN. SWAIN began his online discussions while in Missouri in late February and came to New Orleans this week for a convention at which time he attempted to have sexual relations with a fifteen year old girl living in Kenner who turned out to be an undercover Kenner Police Detective.

SWAIN was brought before United States Magistrate Judge Louis Moore, Jr. who remanded SWAIN to the custody of the U. S. Marshal’s Service. If convicted, SWAIN faces a mandatory minimum of ten (10) years imprisonment up to life, followed by up to a lifetime term of supervised release, a $250,000.00 fine and SWAIN can be required to register as a sex offender.

This investigation is being conducted by the Kenner Police Department and the Federal Bureau of Investigation. The prosecution of this case is being handled by Project Safe Childhood Coordinator, Assistant U. S. Attorney Brian M. Klebba.
