DEFENDANT FOUND GUILTY AFTER A 1- DAY TRIAL

FOR IMMEDIATE RELEASE

SHAUN BAILEY, 34, a resident of New Orleans, Louisiana was convicted by a jury in Federal Court for possessing a firearm as a convicted felon after a one-day trial announced U. S. Attorney Jim Letten. Sentencing is scheduled for April 24, 2008 at 10:30 A.M. before U. S. District Judge Feldman. The defendant faces a maximum ten (10) years imprisonment.

According to the testimony at trial, on July 25, 2007, at approximately 1:50 A.M., New Orleans Police Officers responded to the report of a possible trespasser in the area of the 8000 block of Green Street in New Orleans. Officers encountered BAILEY who matched the description of the trespasser. As officers attempted to detain the defendant, a struggle ensued. During the struggle, BAILEY dropped a six-shot revolver which was loaded with four rounds of ammunition. BAILEY has two previous convictions in Orleans Parish - a February, 1993 conviction for armed robbery, and a December, 2002 conviction for firearms and drug charges.

The case was investigated by the New Orleans Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives as part of the Department of Justice’s Violent Crime Task Force. The prosecution was handled by Assistant U. S. Attorney Sean Toomey and Richard W. Rose.
