The Wage and Hour Commission administers, executes and carries out provisions of the child labor laws. The Wage and Hour Commission is empowered by statute to make rules regulating the employment of minors.
The commission investigates compliance with its rules and conducts studies to evaluate existing rules and to identify those that need to be changed. The commissioner may impose civil penalties for violation of child labor rules or the orders of the Wage and Hour Commission.
Annual Employment Certificates
The Wage and Hour Commission is responsible for adopting rules that govern the filing of annual employment certificates. Employers who hire employees younger than 18 years must comply. See Child Labor.
Selection of Commissioners
Three Wage and Hour commissioners are appointed by the governor. Their terms are four years in length. Commissioners cannot all be members of the same political party. In making a selection, the governor is obligated to give due consideration to the interests of labor, industry and the public. The governor´s selections are subject to approval by the Senate.
Commission Chairperson
Each year, on or before January 20, the commission elects its chairperson from the three members. The commissioner acts as executive officer of the commission. Any act or decision of the commission must be made by a quorum, or at least two, of the commission members.
