About the Position
The purpose of this position is to assist Measure 49 claimants and public entities in the review and resolution of disputes involving Measure 49 claims and the supplemental review and resolution of Measure 37 claims.
 
Specifically, if requested by a claimant who intends to file a new Measure 49 claim for land use regulations adopted after January 1, 2007, the Ombudsman may review a proposed claim to assist the claimant in ensuring that the claim contains all of the information needed for it to be complete.
 
In addition, if requested by either a Measure 37 claimant or by DLCD, the Ombudsman may facilitate resolution of issues involving existing Measure 37 claims.
 
Issues involving the supplemental review of existing Measure 37 claims to determine if they are eligible for relief under Measure 49 are likely to involve questions such as:
  • determining what is necessary to show whether a property could have been divided when it was acquired;
  • who the current owner of the property is, and when he or she acquired the property;
  • what land the property described in the claim includes; and
  • appraisal requirements.
 
The Ombudsman may identify other possible means by which property owners/claimants may be able to carry out desired uses of their property (other than by pursuing a Measure 49 claim), and refer claimants and potential claimants to other sources of assistance, including local governments.
