Second and third generation night vision image intensifier tubes and devices manufactured outside the United States or Canada may be acquired if-- (a) Adequate domestic supplies are not available to meet DoD requirements on a timely basis; and (b) The Secretary of the Department responsible for the acquisition certifies to the House and Senate Committees on Appropriations that the acquisition of tubes and devices manufactured outside the United States or Canada is necessary in order to acquire capability for national security purposes.
