Cuba: Status of Boat Used by Border Guard Personnel To Travel to Key West, Florida

Question: What is the status of the boat used by Cuban Border Guard personnel to travel to Key West, Florida?

Answer: After investigating the circumstances of the vessel’s departure from Cuba and arrival in the United States, we determined that the boat was a sovereign warship of the Cuban Border Guard, an armed service of the Cuban Government.

Based on the concept of reciprocity and on the well-settled principle of sovereign immunity, the United States returned the vessel to the Cuban Border Guard on February 9, 2003. The transfer took place on the high seas.
