Ribi Immunochem Research, Inc. et al., Civil Action No. 98-55-M-LBE, with the United States District Court for the District of Montana. The Consent Decree resolves contribution claims brought on behalf of the National Institutes of Health (``NIH'') against defendants Charles Mann, Mary Louise Mann, and Bitterroot Valley Sanitary Landfill, Inc under Sections 107 and 113 of the Comprehensive Environmental Response, Compensation and Liability Act of 1980, as amended (``CERCLA''), 42 U.S.C. 9607 and 9613, with respect to the Bitterroot Valley Sanitary Landfill and surrounding areas (the ``Site''). The Site is located in Hamilton, Montana. Under the proposed consent decree, defendants Charles Mann, Mary Louise Mann, and Bitterroot Valley Sanitary Landfill, Inc will pay $440,000 in contribution for response costs incurred by the National Institutes of Health (``NIH'') for response costs incurred in connection with the Site. The Department of Justice will receive comments relating to the proposed Consent Decree for a period of thirty days from the date of publication of this notice. Comments should be addressed to the Assistant Attorney General, Environment and Natural Resources Division, Department of Justice, Washington, D.C. 20530, and should refer to United States v. Rivi Immunochem Research, Inc., Civil Action No. NO.98-55-M-LBE, DOJ Ref. No. 90-11-3-1713. The proposed Consent Decree may be examined at the office of the United States Attorney, District of Montana, United States Attorney's Office, Russell Smith Courthouse, 201 E.
