Eastern Poly Packaging Co., Inc., CV-96-4079, was lodged on April 9, 1999, with the United States District Court for the Eastern District of New York. The Consent Decree addresses violations of the Clean Air Act (the ``Act''), 42 U.S.C. 7401-7671, and the State Implementation Plan for the State of New York (``SIP'') promulgated pursuant to Section 110 of the Act, 42 U.S.C. 7410 at Defendant Eastern Poly's printing facility located at 149 47th Street, Brooklyn, New York. The Consent Decree requires the Defendant to pay a civil penalty of $135,000 and to submit quarterly monitoring reports for one year. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed consent decree. Comments should be addressed to the Assistant Attorney General for the Environment and Natural Resources Division, Department of Justice, Washington, DC 20530, and should refer to United States v. Eastern Poly Packaging Co., Inc., DOJ Ref. #90-5-2-1-2022.
