ACTION: Extension of time limit, for preliminary review results of antidumping duty administrative review. ----------------------------------------------------------------------- SUMMARY: The Department of Commerce (``the Department'') is extending the time limit for the preliminary review results of the administrative review of the antidumping duty order on dynamic random access memory semiconductors of one megabit or above (``DRAMs'') from the Republic of Korea, covering the period May 1, 1998, through April 30, 1999, since it is not practicable to complete the review within the time limit mandated by section 751(a)(3)(A) of the Tariff Act of 1930, as amended (``the Act''). EFFECTIVE DATE: December 20, 1999. SUPPLEMENTARY INFORMATION: Applicable Statute Unless otherwise indicated, all citations to the statute are references to the provisions as of January 1, 1995, the effective date of the amendments made to the Act by the Uruguay Rounds Agreements Act. In addition, unless stated otherwise, all citations to the Department's regulations are to the current regulations codified at 19 CFR 351 (1998). Background On June 30, 1999 (64 FR 35124), the Department initiated an administrative review of the antidumping duty order on DRAMs from the Republic of Korea, covering the period May 1, 1998 through April 30, 1999. On November 17, 1999, Micron Technology, Inc. (``Micron''), the petitioner, submitted a request for postponement of the preliminary determination on DRAMs from Korea, citing the number and the complexity of the issues involved in the administrative review, including many complex accounting issues. Postponement of Preliminary Result of Review Section 751(a)(3)(A) of the Act requires the Department to make a preliminary determination within 245 days after the last day of the anniversary month of an order for which a review is requested and a final determination within 120 days after the date on which the preliminary determination is published. However, if it is not practicable to complete the review within the time period, section 751(a)(3)(A) allows the Department to extend this time period to 365 days and 180 days, respectively. We determine that it is not practicable to complete the preliminary review results within the original time frame (January 30, 2000 ) because of the complex legal and methodological issues involved in this review segment (see December 10, 1999, Memorandum from Holly Kuga, Deputy Assistant Secretary to Robert LaRussa, Assistant Secretary). Accordingly, the deadline for issuing the preliminary results of this review is now no later than May 30, 2000. The final determination will occur within 120 days of the publication of the preliminary results. These extensions are in accordance with section 751(a)(3)(A) of the Act (19 U.S.C. 1675 (a)(3)(A)).
