Take notice that on May 14, 1999, Transcontinental Gas Pipe Line Corporation tendered for filing Substitute Second Revised Sheet No. 374F.01 as part of its FERC Gas Tariff, Third Revised Volume No. 1, to become effective May 1, 1999. On March 31, 1999, Transco filed in the captioned docket to revise Section 42.10(a) of the General Terms and Conditions of Transco's tariff to permit a Replacement Shipper that desires to re-release capacity to specify Recall Rights for that re-released capacity even through Recall Rights were specified by a prior Releasing Shipper. Transco's proposal was intended to provide a Replacement Shipper with increased flexibility in structuring a re-release of capacity, including specifying Recall Rights for that re-released capacity. On April 29, 1999, the Commission issued an ``Order Accepting Tariff Sheet Subject to Conditions'' (April 29, Order), which requires that Transco file within fifteen days of the date of the order a revised tariff sheet to address customer concerns that subsequent re-releasing shippers of capacity not adversely affect the prior releasing shipper's recall rights. In compliance with the April 29 Order, Transco has revised Section 42.10(a), and submits that the revision is consistent with Transco's intent in proposing the modification to Section 41.10(a) in this proceeding, and with the Commission's policy as stated in the April 29, Order. Any person desiring to protest this filing should file a protest with the Federal Energy Regulatory Commission, 888 First Street, N.E., Washington, D.C. 20426, in accordance with Section 385.211 of the Commission's Rules and Regulations. All such protests must be filed as provided in Section 154.210 of the Commission's Regulations. Protests will be considered by the Commission in determining the appropriate action to [[Page 28817]] be taken, but will not serve to make protestants parties to the proceedings.
