ACTION: Notice. ----------------------------------------------------------------------- SUMMARY: This notice announces Agency approval of applications to register the pesticide products Cygnus Fungicide and Kresoxim-Methyl Manufacturing Use Product containing new active ingredients not included in any previously registered products pursuant to the provisions of section 3(c)(5) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended. EPA received applications from BASF Corporation 26 Davis Drive, P.O. Box 13528, Research Triangle Park, NC 27709-3528, to register the pesticide products Cygnus Fungicide and Kresoxim-Methyl Manufacturing Use Product (EPA File Symbol 7969-REU and 7969-RLG), containing the active ingredient kresoxim-methyl (methyl (E)-methoxyimino-2-[2-(o- tolyloxymethyl) phenyl] acetate) at 50.0 and 94.0% respectively, an active ingredient not included in any previously registered products. However, since the notice of receipt of these applications to register the products as required by section 3(c)(4) of FIFRA, as amended did not publish in the Federal Register, interested parties may submit written comments within 30 days from the date of publication of this notice for this product only. Comments and data may also be submitted electronically to: opp-docket@epamail.epa.gov. These applications were approved on September 30, 1998, for the two products listed below: 1. Cygnus Fungicide for use on greenhouse ornamentals (EPA Registration Number 7969-124). 2. Kresoxim-Methyl Manufacturing Use Product for formulating fungicide products; for use on greenhouse ornamentals (EPA Registration Number 7969-153). The Agency has considered all required data on risks associated with the proposed use of kresoxim-methyl (methyl (E)-methoxyimino-2-[2- (o-tolyloxymethyl) phenyl] acetate), and information on social, economic, and environmental benefits to be derived from use. Specifically, the Agency has considered the nature of the chemical and its pattern of use, application methods and rates, and level and extent of potential exposure. Based on these reviews, the Agency was able to make basic health and safety determinations which show that use of kresoxim-methyl(methyl (E)-methoxyimino-2-[2-(o-tolyloxymethyl) phenyl] acetate) when used in accordance with widespread and commonly recognized practice, will not generally cause unreasonable adverse effects to the environment. More detailed information on these registrations are contained in the EPA Pesticide Fact Sheet on kresoxim-methyl (methyl (E)- methoxyimino-2-[2-(o-tolyloxymethyl) phenyl] acetate). A copy of the fact sheet, which provides a summary description of these pesticides, use patterns and formulations, science findings, and the Agency's regulatory position and rationale, may be obtained from the National Technical Information Service (NTIS), 5285 Port Royal Road, Springfield, VA 22161.
