The petitioner presented new evidence that the company shifted production of certain brake systems to Mexico and importing like or directly competitive articles into the U.S. The notice was published in the Federal Register on December 10, 1998 (63 FR 68304). The Department initially denied TAA to workers of Lucas Varity because the ``contributed importantly'' group eligibility requirement of Section 222(3) of the Trade Act of 1974, as amended, was not met and because the group eligibility requirements of Section 250 of the Act were not met. The workers at the subject firm were engaged in employment related to the production of brakes and brake parts. On reconsideration, the Department requested that Lucas Varity provide additional information on the production of brakes for KIA. The additional information provided by the company indicated the following: (1) The KIA work, which amounted to less than three percent of the company's sales and labor, was shifted to Mexico during the period August, 1997 through February, 1998; and (2) as of May 18, 1998 all workers at the subject firm had been recalled from various temporary lay-offs. Conclusion After reconsideration, I affirm the original notice of negative determination regarding eligibility to apply for worker adjustment assistance and NAFTA-Transitional Adjustment Assistance for workers and former workers of Lucas Varity, North American Light Vehicle Braking System, Mount Vernon, Ohio.
