Glen Cove Development Company and Village Green Realty at Garvies Point, Inc., Civil Action No. CV-99-5600, was lodged with the United States District Court for the Eastern District of New York. The proposed Consent Decree will resolve the United States' claims under the Comprehensive Environmental Response, Compensation, and Liability Act (``CERCLA''), 42 U.S.C. 9601 et seq., on behalf of the U.S. Environmental Protection Agency (``EPA''), against defendants glen Cove Development Company and Village Green Realty at Garvies Point, Inc. (the ``Settling Defendants''), with respect to the Li Tungsten Superfund Site located in Glen Cove, Nassau County, New York. The Complaint alleges that the Settling Defendants are liable as current owners within the meaning of section 107(a)(1) of CERCLA, 42 U.S.C. 9607(a)(1). The proposed Consent Decree also will resolve any liability with respect to the Li Tungsten Superfund Site of certain entities related to the Settling Defendants, namely Old Court Holding Company, Old Court Joint Ventures, Inc., and Old Court Savings and Loan, Inc., (In Receivership). Pursuant to the Consent Decree, the Settling Defendants, and Old Court Holding Company, Old Court Joint Ventures, Inc. and Old Court Savings and Loan, Inc. (In Receivership) jointly will pay to the United States $325,000.00 in reimbursement of response costs incurred or to be incurred by EPA or the Department of Justice at or in connection with the Li Tungsten Superfund Site. The Department of Justice will receive for a period of fifteen (15) days from the date of this publication comments relating to the proposed consent decree. Any comments should be addressed to the Assistant Attorney General of the Environment and Natural Resources Division, Department of Justice, Washington, DC 20530, and should refer to United States of America v. Glen Cove Development Company and Village Green Realty at Garvies Point, Inc., Civil Action No. CV-99- 5600, D.J. Ref. 90-11-3-06561/1. The proposed consent decree may be examined at the Office of the United States Attorney, Eastern District of New York, One Pierrepont Plaza, 14th Floor, Brooklyn, New York 11201 and at Region II, Office of the Environmental Protection Agency, 290 Broadway, New York, NY 10007- 1866.
