ACTION: Closure of public land between sunset and sunrise. ----------------------------------------------------------------------- SUMMARY: Public land located in Owyhee County, known as the Jump Creek Recreation Site, is closed to public use between sunset and sunrise, year round. The closed area is generally described as: West of State Highway 95, South of State Highway 55, adjacent to Jump Creek, Jump Creek Recreation Site, T. 2 N., R. 5 W., Section 27, SE\1/4\SW\1/4\NW\1/4\, S\1/2\SE\1/4\NW\1/4\, E\1/2\NW\1/4\SW\1/4\, W\1/2\NE\1/4\SW\1/4\, NE\1/ 4\NE\1/4\SW\1/4\. The described area is the site of growing crime, especially during evening hours. Reported incidents of illegal dumping, drug transactions, under-age parties involving drug and alcohol consumption, use of firearms, theft, and destruction of public property, have increased steadily over past years. The purpose of the closure is to provide for public safety and resource protection. The area will be signed to identify the closure. Law enforcement personnel will enforce the closure regularly. Exceptions to this closure may be approved by the Authorized Officer. Exemptions may be approved for federal, state, and local government personnel on official duty, emergency service personnel including medical, search and rescue, utility services, and other licensed or permitted individuals. This closure order is effective 30 days after publication and public review unless otherwise rescinded. It will remain in effect until rescinded or modified by the authorized officer. The authority for this closure is 43 CFR 8364.1, Closure and Restriction Orders. Failure to comply with this order will subject violators to the penalties provided in 43 CFR 8360.0-7, punishable by a fine not to exceed $1,000 and/or imprisonment not to exceed 12 months.
