Take notice that on March 19, 1999, The Montana Power Company (MPC) filed a petition for adjustment and notice of rate election pursuant to Section 284.123(b)(1)(ii) of the Commission's regulations. MPC requests waiver of the rate petition filing required by the Commission's November 3, 1997 order [81 FERC para. 61,156 (1997)], and permission to switch from its Commission-approved rate for Section 311 interruptible transportation (IT) service to its city-gate rate of $0.2480 per Dkt for comparable IT service. MPC is a Hinshaw pipeline organized under the laws of the State of Montana and subject to the jurisdiction of the Montana Public Service Commission. Montana states that is request to use a state-approved rate for interstate IT service is consistent with its current use of a city- gate rate for Section 311 firm transportation and interruptible storage services. Any person desiring to participate in this rate proceeding must file a motion to intervene or protest with the Federal Energy Regulatory Commission, 888 First Street, NE, Washington, DC 20426, in accordance with Sections 385.214 and 385.211 of the Commission's Rules of Practice and Procedures. All such motions or protests must be filed with the Secretary of the Commission on or before April 15, 1999. Protests will be considered by the Commission in determining the appropriate action to be taken, but will not serve to make Protestants parties to the proceedings.
