Richard Mottolo, K.J. Quinn & Co., Inc., et al., Civil Action No. 83-547-B, was lodged with the United States District Court for the District of New Hampshire. The proposed Consent Decree will resolve the United States' claims under the Comprehensive Environmental Response, Compensation, and Liability Act (``CERCLA''), 42 U.S.C. 9601, et seq., on behalf of the U.S. Environmental Protection Agency (``EPA'') against the K.J. Quinn & Co., Inc., relating to the Mottolo Superfund Site (``Site'') located in Raymond, New Hampshire. The K.J. Quinn & Co., Inc., was previously adjudicated liable under Section 107(a) of CERCLA, 42 U.S.C. 96097(a). Pursuant to the Consent Decree, the K.J. Quinn & Co., Inc., has agreed to reimburse to the United States $2,000,000 for costs incurred and to be [[Page 55749]] incurred by the DPA at the Mottolo Site after May 1, 1990. Costs that were incurred by the DPA prior to May 1, 1990, were addressed in a previous consent decree with the K.J. Quinn & Co., Inc. The K.J. Quinn & Co., Inc., has already paid $1,445,949 of the $2,000,000 amount and is to make the remaining payment of $554,051, along with interest from October 16, 1998, within 7 days of entry of this Consent Decree. The Department of Justice will receive for a period of thirty (30) days from the date of this publication comments relating to the proposed consent decree. Any comments should be addressed to the Assistant Attorney General of the Environment and Natural Resources Division, Department of Justice, Washington, D.C. 20530, and should refer to United States v. Richard Mottolo, K.J. Quinn & Co., Inc., et al., Civil Action No. 83-545-B, D.J. Ref. 90-11-2-17. The proposed consent decree may be examined at the Office of the United States Attorney, District of New Hampshire, 55 Pleasant Street, Concord, New Hampshire 03301 and at Region I, Office of the Environmental Protection Agency, One Congress St., Boston, MA 02203.
