Eagle-Picher Industries, Inc., and Exide Corporation, Civil Action No. 3:99-CV-2140-T, was lodged with the United States District Court for the Northern District of Texas, Dallas Division. The proposed Consent Decree resolves the liability of Eagle-Picher Industries, Inc. under Sections 106 and 107 of CERCLA at the RSR Superfund Site (``Site'') located in Dallas, Texas. Under the terms of the Consent Decree, Eagle-Picher has agreed to an Allowed Environmental Claim in its Chapter 11 Bankruptcy proceeding for the United States in the amount of $2.1 million. For a period of thirty (30) days from the date of this publication, the Department of Justice will receive written comments relating to the proposed consent decree from persons who are not parties to the action. Comments should be addressed to the Assistant Attorney General, Environment and Natural Resources Division, U.S. Department of Justice, Washington, DC 20530, and should refer to United States v. Eagle-Picher Industries, Inc., et al., DOJ #90-11-3- 1613/2. The proposed consent decree may be examined at the offices of the United States Attorney for the Northern District of Texas, Dallas Division, 1100 Commerce St., 3rd Floor, Dallas, Texas, 75242-16996, and at the office of the United States Environmental Protection Agency, Region VI, 1445 Ross Avenue, Dallas, Texas 75202 (Attention: Mike Barra, Assistant Regional Counsel). A copy of the consent decree may also be obtained by mail from the Department of Justice Consent Decree Library, P.O. Box 7611, Washington, DC 20044. Copies of the decree may be obtained in person or by mail from the Consent Decree Library. Such request should be accompanied by a check in the amount of $6.00 (25 cents per page reproduction charge for decree, payable to ``Consent Decree Library''.
