Mayor and City Council of Baltimore, Civil Action No. 97-4185 (D. Md) was lodged with the court on September 29, 1999. The proposed decree resolves claims of the United States and State of Maryland against the Mayor and City Council of Baltimore under section 309(b) and (d) of the Clean Water Act (the ``Act'' or ``CWA''), 33 U.S.C. 1319(b) and (d), for violations of National Pollutant Discharge Elimination System (``NPDES'') permits issued to the City of Baltimore's Ashburton Water Filtration Plant and Patapsco Wastewater Treatment Plant. In the decree, Baltimore agrees to pay a total civil penalty of $1 million, perform Supplemental Environmental Projects valued at $2.5 million, and implement necessary injunctive relief at both plants. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed consent decree. Comments should be addressed to the Assistant Attorney General for the Environment and Natural Resources Division, Department of Justice, Washington, DC 20530, and should refer to United States and State of Maryland v.
