ACTION: Notice. ----------------------------------------------------------------------- SUMMARY: The fee to cover the average cost of incarceration for Federal inmates is $21,926. SUPPLEMENTARY INFORMATION: Provisions in 28 CFR part 505 allow for the assessment and collection of a fee to cover the average cost of incarceration for Federal inmates. This fee is calculated by dividing the number representing the obligation encountered in Bureau facilities (excluding activation costs) by the number of inmate-days incurred for preceding fiscal year, and then by multiplying the quotient by 365. The initial publication of the fee based upon fiscal year 1994 data was $21,352. Subsequent determinations of the fee were: $23,542 (based upon fiscal year 1995 data), $23,542 (based upon fiscal year 1996 data), $21,838 (based upon fiscal year 1997 data). Pursuant to Sec. 505.2(b), the Director of the Bureau of Prisons has reviewed the amount of the fee and has determined that, based upon fiscal year 1998 data, the fee to cover the average cost of incarceration for Federal inmates is $21,926.
