Marshall, et al., Civil Action No. 98-1478A, was lodged on April 19, 1999 with the United States District Court for the Northern District of West Virginia. The United States filed this action pursuant to the Clean Air Act to obtain an injunction requiring compliance with the National Emissions Standards for the Hazardous Air Pollutant (NESHAPs) Asbestos and to obtain civil penalties for violations of the Clean Air Act and federal regulations. The Consent Decree Sahara Holdings Limited Liability Company to demolish and properly dispose of the Broaddus Apartment Building in Clarksburg, West Virginia. Allen G. Saoud, a former principal in Sahara Holdings Limited Liability Company is required to participate in the demolition and disposal. In addition, the City of Clarksburg has committed to spend up to $10,000 to assist in the proper disposal of the materials removed from the Broaddus Apartment Building. The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed consent decree. Comments should be addressed to the Assistant Attorney General for the Environment and Natural Resources Division, Department of Justice, Washington, DC, 20530, and should refer to United States v. Marshall, et al., Do Ref. #90-5-2-1-2064.
