Take notice that on December 31, 1998, Black Marlin Pipeline Company (BMPL) tendered for filing to become part of its FERC Gas Tariff, First Revised Volume No. 1, the following tariff sheet, effective January 1, 1999: Substitute Ninth Revised Sheet No. 4 BMPL states that on December 30, 1998, the Federal Energy Regulatory Commission issued an order (Order) approving the November 19, 1998 Stipulation and Agreement of Settlement (Settlement) in BMPL's Section 4 Rate Case Filing in Docket No. RP98-274. In compliance with the Order and the terms of the Settlement, BMPL is filing revisions to the referenced tariff sheet to reflect the transportation rates as included in Appendix A of the Settlement, and is moving into effect January 1, 1999 Second Revised Sheet Nos. 200 and 213F eliminating BMPL's transportation revenue sharing mechanism. Any person desiring to protest this filing should file a protest with the [[Page 1799]] Federal Energy Regulatory Commission, 888 First Street, NE, Washington, DC 20426, in accordance with Section 385.211 of the Commission's Rules and Regulations. All such protests must be filed as provided in Section 154.210 of the Commission's Regulations. Protests will be considered by the Commission in determining the appropriate action to be taken, but will not serve to make protestants parties to the proceedings.
