Coastal Eagle Point Oil Co. et al., Civil Action No. 98-3995 (JHR) (D. N.J.) was lodged with the United States District Court for the District of New Jersey on August 25, 1998. In this action the United States sought civil penalties under the Clean Air Act (``CAA''), 42 U.S.C. 7401 et seq., against Coastal Eagle Point Oil Co., Eagle Point Cogeneration Partnership, and Coastal Technology, Inc., (``Coastal''). The alleged violations include certain violations at a boiler plant and cogeneration plant within a petroleum refinery located in West Deptford Township, New Jersey. The consent decree resolves these claims. The consent decree requires Coastal to comply with the Clean Air Act; to pay a civil penalty to the United States of $300,000; and to implement a supplemental environmental project (``SEP'') at an estimated cost of $960,000. The SEP requires Coastal to install and operate an Amine Scrubber Unit in the refinery fuel gas system supply the boiler and cogeneration plants. The Amine Scrubber Unit shall be capable of operating in conjunction with other existing fuel gas treatment units to control the hydrogen sulfide (H2S) concentration of the refinery fuel gas supplied to the boiler and cogeneration plants. The Department of Justice will accept written comments relating to the proposed consent decree for thirty (30) days from the date of publication of this notice.
