Abstract: The Advisory Council on Historic Preservation envisions 
undergoing rulemaking to amend its regulations that implement section 
106 of the National Historic Preservation Act. These few amendments 
would make the regulations comport with the court decision of National 
Mining Association v. Nav, and would allow the Advisory Council to 
pursue section 106 exemptions on its own initiative.
