Treatises

Treatises are single volumes or sets, often regularly updated, that describe and analyze a limited subject area of the law. They can be scholarly, practical, and/or a combination of the two; some offer basic or introductory coverage of a topic, while others are more in-depth.

Westlaw provides several up-to-date, full-text treatises databases on various topics. Below are descriptions of just a few of the many available:

  • Admiralty and Maritime Law, ADMMARL, contains Admiralty and Maritime Law (4th edition) by Thomas J. Schoenbaum. It covers current practice, recent cases and developments, and offers an overview of the history and traditions underlying current law.

  • 2005 Bankruptcy Reform Legislation with Analysis, BAPCPA, contains 2005 Bankruptcy Reform Legislation with Analysis 2d. On October 17, 2005, all remaining provisions of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) became effective. This treatise is an updated version of the first edition and includes almost 200 pages of expanded coverage and analysis of BAPCPA and provides the full-text of Title 11 in red-line form (the 1st edition included only the sections of the Bankruptcy Code that were changed by the new 2005 legislation).

  • eDiscovery & Digital Evidence, EDISCOVERY, contains the two volume set eDiscovery & Digital Evidence along with the forms on CD. It discusses preservation and retention policies, discovery, disclosure, cost sharing, spoliation, and the admissibility of digital evidence, and includes an Appendix, a Table of Laws and Rules, and a Table of Cases.   • Immigration Law Service 2d, IMMLS2D, contains the multi-volume set Immigration Law Service 2d, by Anna Marie Gallagher, which provides a comprehensive approach to current immigration-related issues.

  • Sarbanes-Oxley Act in Perspective, SEC-SOAP, contains The Sarbanes-Oxley Act in Perspective, by Harold S. Bloomenthal, an in-depth analysis of the Sarbanes-Oxley Act of 2002 covering topics such as the Public Company Accounting Oversight Board, Augmenting Enforcement of the Securities Laws, and Private Actions after Sarbanes-Oxley.   • Sutherland Statutes and Statutory Construction, SUTHERLAND, contains all of the author-prepared analytical material in the initial release of the eight-volume print set. It provides a background in legislative law and its role in legal disputes, an exploration of the rules of statutory construction with case law authority drawn from all jurisdictions, and application of the rules of construction to important areas of law that are governed by statutes.

  • Treatise on Constitutional Law: Substance and Procedure (3rd ed), CONLAW

Click on the file folder icon to the left of Forms, Treatises, CLEs and Other Practice Material, then click on the file folder icon to the left of Texts & Treatises in TEXTS & TP-ALL. From there, click on the file folder icon to the left of “Databases beginning with” A,B,C, etc. Use the scope link (green circle with an “i” in the middle) to the left of the database name to get further information regarding a specific database.
