eDiscovery & Digital Evidence

A past tip of the week describes online resources available on the topic of Electronic Discovery. Thanks to a kind donation from SOL’s Division of Plan Benefits Security (PBS), the Wirtz Labor Law Library now has in its print collection a two-volume treatise and CD published in 2005 by Thomson West: eDiscovery & Digital Evidence, by Jay E. Grenig, William C. Gleisner, Troy Larson, and John L. Carroll. The law library’s copy is available in the Treatises section; the call number is KF8947 .G8 2005.

Description (from Thomson West): “This treatise provides guidance in determining when forensic or similar specialized technical help is necessary. It also discusses preservation and retention policies, discovery, disclosure, cost sharing, spoliation, and the admissibility of digital evidence, including computerized business records and computer-generated evidence. Further, its appendices include a detailed glossary, practical forms in print and on CD-ROM, pertinent Federal Rules of Civil Procedure, proposed changes to the Civil Procedure Rules, and Federal Rules of Evidence, comprehensive manuals concerning searching for digital information, and the effective use of technology in the courtroom.” See the Summary of Contents for more information about topics covered in these volumes.

In addition, access is available electronically through Westlaw (only for DOL employees who have Westlaw accounts) using the database identifier EDISCOVERY. It contains the complete contents of the two-volume print set eDiscovery & Digital Evidence together with the companion forms included on the CD.
